The system has deteriorated to such a state in uttar pradesh, that the barbaric strength only prevails over every part and personality. The latest example is man handling of the govt.doctor by a politician. Samajwadi Party Yuvjan Sabha district president Om Pal Gujar  allegedly slapping a government doctor   Dr Gupta ,as he had refused to withdraw an FIR (first information report) he had lodged against the quack. the U.P.state is notorious for  atrocities on weaker sections.  Doctors are one of the easily vulnerable weaker section in the society due to their intellectual idiosyncrasies and lack of unity. No doubt,IMA- UP state wouldn't hesitate to take strong legal  stand against erring political leader. IMA has to use the constitution's 4 arms -judiciary,legislature,media,beurocracy- to get the due justice. IMA repeatedly requesting all medical fraternity to fight under its expanding  umbrella of security.

Medical Education -News:

300-hr course a must for MBBS doctors wanting to do ultrasounds Tuesday, July 24, 2012  Any MBBS doctor wanting to do ultrasounds will now be required to do a 300-hour course in the basics of ultrasonography approved by the Medical Council of India (MCI) and conducted by an MCI-recognised institution. The government has mandated the course under the Pre-conception and Pre-natal Diagnostic Techniques (Prohibition of Sex Selection) Act 1993, which says any MBBS wanting to do ultrasounds must take six-month training in the area. MBBS doctors, already practicing ultrasonography on the basis of the old provision in the law, will need to clear a competency test at the time of renewal of their clinic’s registration

1.  CBI closes assets case against ex-MCI chief  .  The CBI had booked Desai after allegedly finding “illegal assets” worth Rs 24 crore during raids at his properties in Delhi and Ahmedabad. But after a two-year-long probe , the agency concluded that “the allegations could not be substantiated”. CBI also  probed about two dozen colleges across India and charge-sheeted former health minister Anbumani Ramadoss for granting illegal favours to a college in Indore. 2. CBI closes  DA case against ex-DCI boss - In September 2011, Kohli was accused by the CBI of allegedly amassing wealth disproportionate to his known sources of income. 3.   IRIA got stay in toto at delhi high court against the recent amendments of PCPNDT ACT.

Residency pay scales

Long time ago, the SC gave a judgment as a result of which the residency scheme with proper pay scales was introduced. (Before that, residents were paid a "stipend"). This judgment also gave detailed guidelines about the working hours of residents, including the maximum in a week and the maximum permissible at a stretch. The Government of India introduced the Residency Scheme in replacement of the system of House Surgeons, Postgraduate students and Registrars in Central Institutions/Hospitals. The said scheme is dated 22.4.1974. The scheme dated 22-4-1974 was announced by the government pursuant to a SC judgment, as far as I remember. What action can be taken against hospitals employing non-MBBS doctors.?

it may attract    legal actions  against such hospitals in consumer courts, hospital registering authorities and medical council and judiciary. as per  the national Consumer Commission judgment on 16 Aug. 2007, it was observed in para 20 of the judgment as follows: {    judgment can be viewed at—  http://ncdrc.nic.in/OP21497.HTML   } "When a patient is admitted in a hospital, it is done with the belief that the treatment given in the hospital is being given by qualified doctors under the Indian Medical Council Act, 1956.      We hold that it is clear deficiency in service and negligence by the hospital for leaving the patient in the hands of non-MBBS doctor .” so, its sincere advise from IMA-HBI to all such hospitals to restrain from employing non-MBBS doctors.

Is MCI has any control over the change of curriculum or duration or modalities of the MEDICAL UG COURSE?

No. It has no such authority.  As per  section 19A of the IMC Act, 1956 , MCI can only  recommend  to the states and after getting prior approval from the states,MCI will forward it to the union govt (MOH )  which is the deciding authority. Unless the medico has entered in to any bond with the govt. prior to the admission in to the said course,the medico is not legally bound to do compulsory rural service. As per existing law, once the internship is satisfactorily completed, a doctor is granted permanent registration.

Annual Health Survey-2011: India's first district-level health survey showed that 57 districts (out of 287 dist . surveyed ) have the worst health indicators in terms of birth rate, infant mortality rate, maternal mortality rate and sex ratio.
