when ever any unfortunate mischap happened in our medical profession,every doctor should act in a calm & composed manner with the help of able medico-legal advocate or expert and local IMA executive.
the doctor has to keep all relevant medical records - OP sheet,medical and diagnostic findings report copy, admission or treatment sheet,informed consent, operation or procedure notes, discharge summary,bill receipts,etc..
All negligence cases must be evaluated by expert medical committee before filing any cases against the doctor. with out expert committee report the police authorities has no power to file criminal cases against the doctor.(as per supreme court judgment )
Under medical protection ACT 11 of 2008, ( PUBLISHED ON 22-4-08 IN A.P. GAZETTE.) the police must arrest and file cases under cognizable offence sections against the persons who -trespassed the duties of doctor and his hospital staff.
