More than two years after it was announced by the President during the joint session of Parliament in 2009, the National Commission for Human Resources for Health (NCHRH) Bill, 2011 is likely to come in the Cabinet on Tuesday.
After receiving the vetted draft bill from the law ministry last month, the bill was sent to the Cabinet early this month. “After the proposed bill is cleared by the Cabinet, it will be introduced during this session,” a senior official in the health ministry said.
The NCHRH Bill aims at creating a super medical authority by scrapping all other regulatory bodies. Once passed, all independent bodies like Medical Council of India (MCI), Dental Council of India (DCI), Pharmacy Council
of India and Nursing Council of India will come under the over arching council.
With an aim to help facilitate foreign National doctors practice in India — a new clause — has been put in the bill. As of now these doctors could come to teach or research on charitable basis only to India. Along with this, the ministry has also proposed an exemption for the overseas citizens of India (OCI) to practice medicine in India without appearing for the screening test.
The proposed bill had got into rough weather after the Human Resource Development (HRD) announced taking over medical education in their proposed NCHER bill.
The Union health ministry strongly objected to it and approached the Cabinet for the clearance of their proposed National Commission for Human Resources for Health (NCHRH) Bill, 2011-even after waiting long for the HRD to send its comments.
Later, both the ministries arrived at rapprochement for drafting the legislations at the behest of the Prime Ministers Office. Both got stuck again, as the health ministry found that some clauses of the HRD’s bill were “over-riding” provisions our NCHRH. The matter was again sorted out and the bill was sent to the law ministry for vetting in October this year.
